Undivided Interest
“Imagine ten of us inherited one family farm. Nobody owns the north field or the south field. Every one of us owns a share of the entire farm. That’s an undivided interest.”
“Why do I even need to know what an undivided interest is ?”
Because those two words appear throughout the deeds, probate records, tax records, heirship, valuation and court filling.
Knowing the term changes your ability to read your packet.
This become the foundation for understanding the pages that follow. Why this two words keep appearing in my documents?
Why it matters: Because it helps you understand what your facing.

“If everyone owns an interest in the whole property, how do courts decide what happens when the heirs don’t agree?”
“Wait… we don’t all agree. Now what?”
“O.k what does the law say? We have a law? I’m not following ?”

“The law was revised in 2021.” Now, Im really want to know!, ummmm… ok, 164 was revised to open up options for heirs to sell their interest. What we are preserving not selling…OMG!i well don’t panic, this is justifiable thinking,

3-Pumpkins grew
2 Pumpkin detached from the vine.
And as you can see one still attached to the vine.
The pumpkin going to cure for another 7-14 days the orange color is bright and will darken soon. This year pumpkin patch produced 3 humongous pumpkins in the back yard for harvest

What is equity?
“Equity… what does that mean?”
“I hear people say it all the time.”
“Well, think about your family.”
“If Grandma passes away and leaves her home to her children, equity is the value each person’s ownership interest represents after debts and obligations are accounted for. It is the value tied to an ownership interest—it isn’t the same thing as the property itself.”
“So… equity isn’t just cash?”
“No. It’s the value connected to what you own.”
“Oh… now I understand.”

What is Conveyance??
Uncle, did you say its a transfer of an ownership interest in property from one person or entity to another.
I said how did ownership move from one person to another? well that’s another great question? because now this leads to what they call quitclaims deed.

It’s a legal document that transfers whatever ownership interest a person has, if any, to someone else.
The point transfers interest the signer has
It does not guarantee that the signer owns the property.
It does not guarantee that the title is free of other claims or liens.

A Royal Patent in Hawaii is a formal land-title document issued under the Hawaiian Kingdom that confirms a person’s ownership of a specific piece of land.

Once upon a time when Lady Enoka was young, she asked her uncle who lived on the tip of the mountain. Hey Uncle, “what’s a shape shifter” he had the biggest smile. Geeeeeeee nobody when ask me for a long time…but not any legend this the wahine she was ugly just like you uhhhhh? yeah her beauty yet a giant supernatural mo’o.

What is a Royal Patent anyway?

A Royal Patent is part of Hawai’i’s old land title system. It is a government-issued document from the Hawaiian Kingdom confirming an award or grant of land.
Mason (uncle)…so if our land comes from a Royal Patent that means the family owns it?

it means the Royal Patent is part of the root of title-the history showing where the legal title came from.
Our land is described as Royal Patent Grant …The parcel? then why we have to go to court?
Because the Royal Patent can tell you where the title began.
It does not freeze everything forever.
What you mean, I don’t understand .
After generations pass, land can become divided among heirs. Interests can be transferred. People can die without probate being finished. Somebody can sell their share. Somebody can file quiet title somebody can ask for partition.
And suddenly the royal Patent can have dozens sometimes hundreds of descendants connected to it.
Yes that’s called hui all of us come together! Hawaiian Roots
…but the Judge don’t look at it that way the judge rule because got to much heirs this is saying our land already sold with out our consent! ummmmm let’s go over this again…

Land Commission Award (LCA) - claimant testimony whether the patent arose from that award…
Aina - Island, moku/district, ahupua’a, ‘ili, kuleana, and traditional places names...
Apana - Each separate parcel or portion covered by the award or patent…
Survey - survey number, surveyor, metes and bounds, traditional boundary markers… courses and distances records and archival collections may exist separately…
