Undivided Interest
“Imagine ten of us inherited one family farm. Nobody owns the north field or the south field. Every one of us owns a share of the entire farm. That’s an undivided interest.”
“Why do I even need to know what an undivided interest is ?”
Because those two words appear throughout the deeds, probate records, tax records, heirship, valuation and court filling.
Knowing the term changes your ability to read your packet.
This become the foundation for understanding the pages that follow. Why this two words keep appearing in my documents?

Heirs disagree
“If everyone owns an interest in the whole property, how do courts decide what happens when the heirs don’t agree?”
“Wait… we don’t all agree. Now what?”
“O.k what does the law say? We have a law? I’m not following ?”
Wait, what’s going on?
“The law was revised in 2021.” Now, Im really want to know!, ummmm… ok, 164 was revised to open up options for heirs to sell their interest. What we are preserving not selling…OMG!i well don’t panic, this is justifiable thinking,
“Does it help our case?”
”…Yes?”
“Then what do we do now?” Start coming into consensus!!

Table Talk # 9 side note
“this is wonderful agriculture…kids still malama.”
It isn’t only about growing pumpkins. its teaching that food has a season, that soil has to be cared for, that weeds compete, that patience matters, and that harvest comes after months not days. it takes 120 days to grow a pumpkin. We started the first week of June and will be ready the second to third week of October!!!

What is equity?
“Equity… what does that mean?”
“I hear people say it all the time.”
“Well, think about your family.”
“If Grandma passes away and leaves her home to her children, equity is the value each person’s ownership interest represents after debts and obligations are accounted for. It is the value tied to an ownership interest—it isn’t the same thing as the property itself.”
“So… equity isn’t just cash?”
“No. It’s the value connected to what you own.”
“Oh… now I understand.”

Neighbor: “Could anything have been done differently?”
Secretary: “That’s why we preserve the documents. The record helps future generations understand the choices that were made.”

Secretary: “some are. But many court filings are public records.”
Neighbor: “So anybody can read them.”
Genealogist: “if they’re part of the public court record, yes. The challenge isn’t alsways finding them - it’s understanding what they mean.”

What is Conveyance??
Uncle, did you say its a transfer of an ownership interest in property from one person or entity to another.
I said how did ownership move from one person to another? well that’s another great question? because now this leads to what they call quitclaims deed.

It’s a legal document that transfers whatever ownership interest a person has, if any, to someone else.
The point transfers interest the signer has
It does not guarantee that the signer owns the property.
It does not guarantee that the title is free of other claims or liens.
